Effective Date: 14 August 2019
These general terms and conditions (the “General Terms”) set out the material, legal and financial conditions between Paperjam S.A., established and having its registered office at L-1618 LUXEMBOURG, 10, rue des Gaulois, registered with the Luxembourg Trade and Companies Register under number B95212, represented by its Board of Directors currently in office (hereinafter the “Organizer”),
and the participant (as defined in Article 1.6) named and identified in the General Terms as such (hereinafter the “Participant”),
regarding access to Paperjam Club events.
Definitions
Paperjam Club – The service offered by the Organizer to the subscribing Client.
This service provides access to various events including, without limitation, conferences, performances, tastings, lunches, dinners, award ceremonies, talks, parties, galas, trips or guided tours, produced independently by the Organizer (the “Events”).
Paperjam Club Subscribing Client – Any legal entity, company, association or business that has entered into a Paperjam Club membership agreement with the Organizer (the “Client”).
Member Organization – The legal entity, company, association, business, brand or other organization designated as such by the Client. The Member Organization must have a direct economic relationship with the Client (i.e., companies within the same group, subsidiaries, sister companies, commercial brands operated by the Client, etc.).
PAE – “Personnes Autorisées à l’Enregistrement” (persons authorized to register) for Events by virtue of their affiliation or belonging to the Member Organization. This affiliation is established by being an employee, staff member, member of management, or guest of the Member Organization. PAEs are subject to restrictions related to event registration, seat availability, and any specific conditions of the event (e.g., an exclusive event reserved for holders of a specific function such as CEO, HR Director, etc.).
Participants – PAEs who have actually registered for the event and who meet the specific conditions of the event.
Paperjam Club Events
Registrations for Events must be made by the Participant on the website www.paperjam.lu/club or by any other means offered or required by the Organizer. Registration for Events is subject to seat availability. The Organizer does not guarantee the systematic availability of Events and cannot be held liable if the number of available seats is reached for an Event and the Participant can no longer take part as a result. Registration may also be conditional upon payment of a specific entry fee for the Event, independently of the annual Paperjam Club membership fee.
The Organizer reserves the right to refuse access to or exclude from an Event any Participants whose behavior or remarks are contrary to legal and regulatory provisions and to public decency, or who fail to comply with any dress code that may be imposed for a particular Event. Refusal or exclusion of a Participant from an Event on these grounds does not entitle the Participant to a refund of any fees paid at registration.
The Organizer reserves the right to refuse access to a Participant for an Event (in particular a workshop or training) where the Participant is a competitor or represents a major conflict of interest for a trainer.
Conduct and Remarks
The Participant undertakes to behave appropriately during Events and shall refrain from publishing messages or making remarks that are insulting, defamatory, xenophobic, racist, antisemitic, pornographic, revisionist, homophobic, sexist, inciting hatred or violence, or in general contrary to the law, humanist values or public decency.
The Organizer further reserves the right, at any time, to exclude any Participant whose behavior is inappropriate for the “professional” nature of the Events, at the Organizer’s sole discretion.
Protection of Personal Data
In connection with the Events, the Organizer informs Participants that their personal data will be collected by the Organizer for the operation of Paperjam Club in compliance with the General Data Protection Regulation (GDPR), in force since 25 May 2018.
Our Privacy Policy is available here.
Where the Member Organization provides personal data of one of its employees or of a third party, it undertakes to do so in accordance with applicable data protection laws and, in particular, to inform the participant or third party concerned of the processing of their data and to provide them with this Privacy Policy.
Image Rights
The Participant expressly agrees to the taking of photographs or videos during the Events and to the free publication of such photographs and videos on the internet, in the press or on any other medium.
The Participant acknowledges having taken note of the Organizer’s Privacy Policy at the time of signing this Agreement.
Referencing
The Participant authorizes the Organizer to use and reproduce their first and last name on all the Organizer’s media.
Dispute Resolution and Applicable Law
These General Terms are governed by Luxembourg law.
Any dispute that may arise between the Parties concerning the interpretation, validity or performance of these General Terms and their consequences shall be submitted to the exclusive jurisdiction of the District Court of Luxembourg City.
